1. Scope

These Terms of Use ("Terms") govern your use of roamiq.com (the "Site"), operated by LarsCo LLC ("LarsCo," "we," "us"). By accessing or using the Site you agree to these Terms. If you do not agree, do not use the Site.

2. Eligibility

The Site is intended for United States residents who are at least 18 years old (or the age of majority in your state). By using the Site you represent that you meet these requirements.

3. Intellectual property

All content on the Site — text, graphics, logos, product names, photographs, video, and software — is owned by LarsCo or its licensors and is protected by copyright, trademark, and other intellectual-property laws. "ROAMiQ," "Roam IQ," and related marks are trademarks of LarsCo LLC. You may not copy, reproduce, distribute, or create derivative works without our prior written permission.

4. Acceptable use

You agree not to:

• Use the Site for any unlawful purpose.
• Attempt to access non-public areas, accounts, or systems.
• Interfere with or disrupt the Site, including by sending malware, scraping at industrial scale, or running denial-of-service attempts.
• Misrepresent your identity or impersonate any other person.
• Use the Site to harass, threaten, or defraud others.

5. Third-party links and integrations

The Site may link to third-party sites, products, and services (including Stripe, Klaviyo, YouTube, Shopify, and our retail partners). We do not control those third parties and are not responsible for their content, products, or practices. Use of a third-party site or service is governed by that party's own terms and privacy policies.

6. Disclaimer

THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF CONTENT. We do not warrant that the Site will be uninterrupted, error-free, or free from harmful components.

The Site is informational only. Nothing on it constitutes legal, financial, electrical, or safety-engineering advice. Installation, wiring, and operation of any equipment described on the Site is at your own risk and must be performed in accordance with applicable codes and the manufacturer's instructions by qualified personnel.

7. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LARSCO AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE.

Our total aggregate liability for any claim arising out of the Site shall not exceed one hundred US dollars ($100). Nothing in these Terms limits liability that cannot be limited by law, including for gross negligence, willful misconduct, fraud, or death or personal injury caused by our negligence.

8. Governing law and disputes

These Terms are governed by the laws of the State of South Dakota, without regard to its conflict-of-laws principles. Any dispute arising out of or related to the Site shall be resolved by final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, seated in Sioux Falls, South Dakota.

Class-action waiver. YOU AND LARSCO AGREE THAT DISPUTES WILL BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY, NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, REPRESENTATIVE, OR CONSOLIDATED ACTION.

Public injunctive relief. Nothing in this Section prohibits a user from seeking public injunctive relief in a court of competent jurisdiction (see McGill v. Citibank, N.A., 2 Cal. 5th 945 (2017)).

Small-claims carve-out. Either party may bring an individual action in small-claims court in the county where you reside.

Opt-out. You may opt out of this arbitration agreement by sending written notice to [email protected] within 30 days of first accepting these Terms.

9. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced via a notice on the Site for at least 30 days before they take effect; continued use of the Site after the effective date constitutes acceptance.
